Deciphering and navigating the process to effectively support Crown consultations with Indigenous groups during the permitting process for certain exploration projects can be a time consuming, challenging, and costly undertaking for project proponents. Mining lawyer, Tom Provost, of MLT Aikins LLP (Winnipeg) will present an overview of the increasing use of exploration agreements and community benefits agreements between industry and Indigenous groups to facilitate Indigenous engagement activities, the Crown’s duty to consult, and accommodation measures in connection with early and advanced exploration projects; potential pitfalls and regulatory issues to avoid; and recent industry trends and court decisions respecting these types of agreements.
